Terms of Service

These Terms of Service ("Terms") govern your use of the Soberly mobile application (the "App") operated by Kinetic Pathways LLC ("Company," "we," "us," or "our").

By accessing or using Soberly, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use Soberly. By using the App, you represent that you meet this requirement.

2. Purpose of the App

Soberly is a sobriety tracking and motivational application designed for informational and personal development purposes only.

Soberly is not a medical device and does not provide medical advice, diagnosis, or treatment. Do not disregard professional medical advice because of something you read in the App. If you believe you are experiencing a medical emergency, call 911 immediately.

3. User Accounts

You are responsible for maintaining the confidentiality of your account and for all activity under your account.

You agree not to:

  • Create accounts under false identity
  • Impersonate another person
  • Use automated systems to create accounts

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Community & User-Generated Content

Soberly may allow users to post content including text, comments, milestones, reflections, or other submissions ("User Content").

A. Zero Tolerance Policy

We maintain zero tolerance for:

  • Harassment
  • Hate speech
  • Threats
  • Bullying
  • Sexually explicit material
  • Graphic violence
  • Promotion of illegal activity
  • Encouragement of self-harm
  • Spam or scams
  • Objectionable content of any kind

Violation may result in immediate content removal and permanent account termination.

B. Content Monitoring

We reserve the right (but not the obligation) to:

  • Review user-generated content
  • Remove content at our sole discretion
  • Restrict visibility of content
  • Suspend or permanently ban users

We may use automated systems and/or manual review to moderate content.

C. Reporting Mechanism

Users may report objectionable content or abusive behavior through the in-app reporting feature or email: admin@speechly.xyz

Reports are reviewed promptly.

D. Blocking Mechanism

Users may block other users to prevent further interaction.

E. 24-Hour Response Policy

We will review reports of objectionable content within 24 hours and take appropriate action, which may include:

  • Removing content
  • Suspending or terminating accounts
  • Restricting access to community features

F. Removal From Feed

Content determined to violate these Terms may be removed immediately from user feeds and public visibility.

G. User Responsibility

You are solely responsible for the content you post. You agree that your content will not violate any law or third-party rights.

5. Content License

You retain ownership of your User Content. By posting content, you grant Kinetic Pathways LLC a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content within the App.

6. Subscription & In-App Purchases

Soberly may offer subscriptions.

  • Payment is processed by Apple.
  • Subscriptions automatically renew unless canceled.
  • Refunds are handled by Apple according to App Store policies.

7. App Updates

We may release updates, patches, or feature changes at any time. Continued use of the App constitutes acceptance of those updates.

8. Prohibited Uses

You may not:

  • Reverse engineer the App
  • Attempt unauthorized access
  • Interfere with servers
  • Scrape or automate access
  • Use the App for unlawful purposes

9. No Warranties

The App is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties to the maximum extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law: Kinetic Pathways LLC shall not be liable for indirect, incidental, consequential, or special damages arising from your use of the App. If liability is found, it shall not exceed the amount you paid to us in the previous six months or $1,000, whichever is less.

11. Indemnification

You agree to indemnify and hold harmless Kinetic Pathways LLC from any claims arising from your use of the App, your violation of these Terms, or your User Content.

12. Privacy

Your use of the App is also governed by our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the State where Kinetic Pathways LLC is registered. Any disputes shall be resolved in the courts located in that state.

14. Apple-Specific Terms

  • This agreement is between you and Kinetic Pathways LLC, not Apple.
  • Apple is not responsible for the App and has no obligation to provide support.
  • If the App fails to conform to applicable warranties, you may notify Apple for a refund of purchase price.
  • Apple is a third-party beneficiary of these Terms.

15. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance.
